Terms of Service

These terms apply when you use trainamerica.com or buy seats in a Train America course. "We" means Train America Holdings, Inc., 1401 Lavaca Street, Unit 106, Austin, Texas 78701. "You" means you as an individual and the company on whose behalf you are buying seats. "Attendee" means the employee taking the course.

If you have signed a Training Services Agreement with us, that agreement applies instead of these terms.

1. Who can buy

Our courses are for employers training their own staff and are not open to the general public. You must be buying on behalf of an employer, and each attendee must be your employee. We don't charge or accept payment from attendees.

2. Payment

You pay in full at checkout, by card or ACH bank transfer. Prices are in US dollars and don't include sales tax, which is added at checkout where it applies.

Your seat is confirmed once payment clears. Cards clear right away. ACH can take a few business days. We can't admit anyone on a seat that isn't fully paid.

3. Course dates and attendees

You choose a course date at checkout from the dates with seats available. After checkout, we'll email you to collect each attendee's name, email and phone number. Please send them at least 5 days before the course starts. We'll still accept them up to and including the first day of the course. You can change who attends later (see section 5).

4. Cancelling a seat

To cancel or make a change, email us at training@trainamerica.com. Your options after cancellation depend on when we receive your email:

Credit and date changes can be used on any course starting within 12 months of your original course date. If you change your date or take credit within 30 days of your course (60 days for 6 or more seats), that order can no longer be refunded.

The full fee is also owed if an attendee doesn't show up, leaves partway through, is removed under section 6, or leaves your company during the course.

Refunds go back to the original payment method, usually within 5 to 10 business days.

5. Sending someone else

You can swap in a different employee at any time before the course starts, at no charge, as long as the original attendee hasn't started the online coursework, which we send a few days before the course starts. Just email us their name, email and phone number and request a change.

6. Attendees

  • Each attendee must meet the requirements listed on the course page.
  • Each attendee must sign our Attendee Agreement before the course starts.
  • Attendees must follow the facility, attendance, safety and conduct rules. We may remove anyone who creates a safety risk or seriously breaks the rules, and we'll let you know if we do.
  • No video or audio recording of any course.
  • You pay to repair or replace tools, equipment or facilities an attendee damages, loses or destroys, beyond normal wear and tear.
  • We are not the attendee's employer.

7. Changes by us

We may change instructors, equipment, daily schedules or the facility (to a comparable one in the same area), as long as the course itself doesn't materially change. A facility change isn't a cancellation.

If we cancel or reschedule a course for any reason, we'll move your seats to the next available date. If that date doesn't work for you, you can change to another date, take full credit, or ask for a full refund with no fee. You have 30 days from our notice to decide, or until the new course starts, whichever comes first. This is your only remedy when we cancel or reschedule.

If events outside our control interrupt a course once it has started, we'll make up the missed time where we can, but we aren't responsible for the interruption.

8. Insurance

We carry general liability insurance. Ask us and we'll send a certificate of insurance and add you as an additional insured.

9. No guaranteed results

We'll teach each course professionally and as described. We can't guarantee that any attendee will attend, finish or pass a course, get a certification or license, or reach any level of skill or job performance. What you owe doesn't depend on any of those things.

Beyond what's in this section, we make no other promises (warranties) about our courses, express or implied.

10. Course materials

We or our licensors own all course materials. Attendees may use them only to take the course. Neither you nor any attendee may copy or share them, or use them to create or deliver training.

11. Limits on liability

Neither of us is liable to the other for indirect, special, consequential or punitive damages, or lost profits. Each side's total liability is limited to what you paid or owe for the order.

These limits don't apply to unpaid fees, misuse of course materials, damage under section 6, gross negligence, willful misconduct, or anything the law doesn't allow us to limit.

We aren't responsible for travel, hotel, lost wages or other costs you or your attendees incur to attend a course, including if a course is changed, rescheduled or cancelled.

12. Using our website

  • You must be 18 or older to use the site.
  • Course details, dates and prices on the site may change. If we make a pricing error, we'll correct it, and if that affects your order we'll let you cancel for a full refund.
  • Our content, logo and name belong to us. Please don't copy or reuse them without our permission.
  • Please don't misuse the site: no false information, hacking, scraping, or anything illegal.
  • The site is provided as is. We aren't responsible for third-party sites or tools it links to.

13. Other terms

  • The version of these terms in effect when you buy applies to that purchase.
  • Notices can be sent by email.
  • Texas law applies. Any dispute goes to the state or federal courts in Travis County, Texas.
  • If any part of these terms can't be enforced, the rest still applies.
  • Our Privacy Policy explains how we handle personal information.
